VIII. FRAMEWORK CONDITIONS

Aside from personnel administration, work security, industrial medicine and employee representative committees, occupational social work is a professionally autonomous organizational unit. A staff position bound up with the company management could be conceived of as well.
The set-up and the organization of this position have to allow independent and autonomous work.
 
Within the frame of its counselling work occupational social work is not bound by any official restraints.
Utilization through employees is voluntary on principle.
Occupational social work has no controlling function whatsoever.
It is not subject to any non-field-related regulations.
 
  • According to 203 StGB social workers are subject to the oath of secrecy.
 
If counsellors should because of their degree not be subject to this paragraph, this should be stipulated by special agreement (e.g. an additional clause to the work contract within the framework of company regulations).
Records, comprising data worth protecting, are to be kept confidential.
 
In analogy to industrial medicine and work security a firm legal footing of occupational social work, e.g. in the protection of labour law, is to be aspired.
 
This concept was the result of a conference of the federal work group of occupational social work in January 1994. It was passed as the fundamental conceptional framework of the "Federal Association of Occupational Social Work" by the participants of the conference.
